This is what we help you with - termination, dismissal and agreements

There are rarely two employment law cases that are the same, but most fall within a few recurring areas. We represent you in cases of dismissal due to personal reasons or lack of work, dismissal and contestation of dismissal, negotiation of severance pay and buyouts, review of employment contracts and clauses on competition, bonuses and confidentiality, discrimination, offensive special treatment and harassment, work environment problems and disputes with the employer, as well as salary, sick pay and holiday issues. Dismissal due to personal reasons is used when the employer believes that you can no longer perform your work in an acceptable manner, while dismissal due to lack of work is a collective action that must follow the rules of succession.

Dismissal is a more intrusive measure that is reserved for gross misconduct, such as theft or threats. For all three, there are rules to follow, if they are not met, you may be entitled to damages or annulment of the decision. Many employment contracts also contain clauses that are difficult to understand. A non-compete clause can lock you out of a large part of the industry for several years and a confidentiality clause can be more intrusive than you think. We go through your contract and explain exactly what you have agreed to, how it stands legally and what you can possibly negotiate before you sign.

Discrimination, work environment and the right to help without a union

If you have been discriminated against on the basis of gender, age, ethnicity, sexual orientation, functional variation or any other protected ground, you have the right to demand change and possible compensation. The same applies to offensive discrimination and serious work environment problems. We help you document, act and, if necessary, pursue the case further. You have the right to legal assistance regardless of whether you are a member of a trade union or not. If you are a member of a union, the union can represent you, but you can also choose a private employment lawyer if you want a completely independent party or if the union does not take on your case for some reason. Many people find that a labor law lawyer in addition to the union provides extra support and a clearer strategy.

Frequently asked questions in Labor Law for employees

How long is my notice period as an employee?

In the event of voluntary termination, the notice period according to LAS is one month, unless otherwise provided by the collective agreement. If the employer terminates you, the period increases with the length of employment, from one month up to six months. Always check your employment contract and any collective agreement, as they often contain longer periods than the minimum level set by law.

What notice period applies to probationary employment?

A probationary period may not exceed six months and can be terminated at any time without the employer having to give reasons. According to LAS, there is no notice period, but the employer must give at least two weeks' notice. However, many collective agreements give you an actual notice period, so read your agreement before planning your next steps.

Am I entitled to severance pay if I quit?

There is no automatic right to severance pay, but it is something you negotiate, usually when your employer wants you to leave. The amount is affected by your length of employment, your role and how certain the employer's grounds for dismissal are. We will review your situation and help you negotiate fair compensation.

Is a non-competition clause in my employment contract valid?

A non-compete clause can be valid, but only if it is reasonable. It should protect a genuine trade secret interest, be limited in time, usually up to eighteen months, and you are normally entitled to compensation during the binding period. Clauses that go beyond this can be adjusted or declared invalid. Show us your agreement before you sign and we will explain exactly what you are committing to.

What can I do if I have been wrongfully dismissed or dismissed?

If you believe that the termination or dismissal is unjustified, you can request that the decision be declared invalid and claim damages. The deadlines are short, often only two weeks to object, so it is important to act quickly. Save all documentation and contact us immediately so we can assess whether you have a case to pursue.

What is considered offensive discrimination in the workplace?

Offensive discrimination is actions that are repeated and directed at you in a way that can lead to ill health, such as ostracism, ridicule or systematic exclusion. The employer is obliged to prevent and investigate this according to the Swedish Work Environment Authority's regulations. Document the incidents and get in touch so we can discuss how you can pursue the matter further.

This is what happens when you hire us

The first step is always a free initial assessment. You describe what happened, either by phone or through the contact form on the page, and we go through the documentation and give you an initial assessment of the situation. If you decide to proceed with Arbetsjuristen, we present clear terms and a plan for how the case will be handled. You always know what the next step is.
